Copyrights in Online Content

Copyrights in Online Content

-Dr. Lalit Kumar Setia

Everyone is marketing his/her content online and most of the content is being developed using android apps and the latest tools of software on laptops. But it is a must to care about the legal framework of copyrights while creating and disseminating the content online. How to avoid copyrights and stay free from legal issues?

Copyrights in Online Content

Writing Original Content

It is seen most of the time that people start copying and pasting content from others’ written articles and data. It can put people in trouble because the content which is taken from copy and paste may be copyrighted. In case, the content is taken from any other webpage, it is a must to give a reference to the page so that there is no copyright infringement.

Designing original images

It is common that google is used to download the available images on the internet. Whoever designed the image and put it online, is the real owner of the created image. The creative commons license is used to prove the ownership of the images without spending a single penny. It is a must to take permission from the real owner of any image is taken from the internet for using the written content.

Polite language without making criticisms

Always write after thinking twice about whether it will hurt the readers or not. In case, there are possibilities that people will feel hurt from reading the content, it is better not to upload it as an article. The statements should not only be grammatically correct but also be polite to win the heart of others. A person reading your content should enjoy the reading and learn new skills from it.

Facts should be right and accurate

Whatever is given in the content, should contain the facts taken from the trusted portals and websites either of Government or commercial organizations. Never take content whose source is doubtful. There are websites that are making everyone confused with giving wrong details and such details are also being changed at regular intervals. Beware of such data and never use such data in your original content.

Respect the Intellectual Rights of others on Copyrighted content

In this age of technology, everyone has the right to maintain intellectual rights on the content that originated from their mind. Innovation and creativity are art and not everyone is equipped with this art. The original author has copyrights, the exclusive right to use created original content for his/her own purpose. Everyone should respect the intellectual rights of others and take permission from others if it is required to use the same for his/her own purpose. The compositions of music are copyrighted by the persons who compose them. The books are copyrighted by the authors so that no one others can copy the content originally written by them. The images created by painters and games developed by the programmers are also copyrighted. If you are taking permissions and referring to the sources of others in the right way, then it is your respect for their copyrights.

The lawful way for using and transferring copyrights

Since the copyrights are inherent in everything which is originally created by a person, it is very difficult to get rights from others for using their copyrighted content in a lawful manner. One way is to organize surveys and get the information filled in various questions and then use it for own purpose, that is considered originally and since the respondents responded with their desire, there is no copyright of the respondents on their responses. Secondly, it is possible to have a license from the owner of the original copyrighted content, to use the content by paying him/her a royalty. Thirdly, the owner of the content may be hired and then asked to develop the original content for you; the content developed by an employee can be used by the employer.

Methods for protecting the original content on the Internet

Whenever the original content is used to upload as text on a webpage, the owner should add a copyright policy on the webpage and if the owner found anyone using his/her original content without permission, he/she should send a notice to such person, so that it should not happen again. It is worth knowing that an owner retains the copyrights on original content up to 60 years after his/her death.

No infringement if the content is used for some specific purposes

The people are worried about their life and content are written to inspire the people to be motivated and do good work; for this purpose, if any motivational content is used by any person, then it cannot be considered as an infringement, however, it is a must to give reference of the content (for example, courtesy of ‘original writer and source’). Secondly, in case, content is being used for academic purposes to educate others, cannot be considered as infringement if credit is given to the original author or owner of the content used. However, it is a must to ensure fair use of copyrighted material means the use of copyrighted material by someone should not negatively affect the earnings of the copyright owner and he/she should earn well instead of its use by anyone that is why it is required to refer.

Lawsuit of Pearson on Chegg

Recently, a popular company Chegg started its subscription study service which covered to have answers to the questions provided in the textbooks by paying $14.95 monthly. The questions were given in the textbook published by Pearson. On 13th September 2021, Pearson filed a complaint in a court accusing Chegg of illegally giving answer sets to its textbook questions and it is his right to give the answer sets. Chegg answered that Pearson’s textbook copyrights do not grant it a monopoly over the right to solve an end-of-chapter problem. The details are available on this link - https://www.publishersweekly.com/pw/by-topic/digital/copyright/article/87974-chegg-responds-to-pearson-copyright-lawsuit.html

Positive Mindset and Time Management

 Positive Mindset and Time Management

-Dr. Lalit Kumar Setia*

"It does not matter how many times you get knocked down, but how many times you get up". -Vince Lombardi

A person's success and happiness totally depend upon his Attitude. The attitude can be improved and made positive, that will be the ultimate way to remove all the worries of life.

Success with Commitment

It's rightly said,

How to stay positive?

One should not take seriously the times he becomes failed but one should remember and be inspired always from the times he succeeded. There are plenty of articles on determinants of success. Shiv Khera in his book; describes success as a point from which another higher point of growth becomes visible. Soft skills also contribute to achieving success and core knowledge of any specific subject also constitutes the ability to achieve success. But it is also the fact that even after acquiring knowledge and soft skills; persons remained unsuccessful in life and not much known for their contribution.

Understanding success and trying to achieve is basically the process of unlocking the hidden potential through a journey of self-discovery through SWOT Analysis.  It becomes easy to discover the power of 'mindfulness' with the help of meditation programs. In the age of cut-throat competition, the corporate officers participate in various stress management courses to get relaxed from official overload.

While we cannot change the external environment, we can change how we react to it with mindfulness.

The question becomes unanswered that what is most important for achieving success. If we are provided with three elements of Success to compare i.e. Ability, Motivation, and Attitude then which one is most important?

After having a discussion in my class what I realized is - "Ability is what you're capable of doing. Motivation determines what you do. Attitude determines how well you do it."

Ability adds the capacity of an individual and whether he will use the ability or not that depends upon motivation. Some persons are self-motivated and some are tried to be motivated. Once a person is motivated, further how well he uses his abilities depends upon his attitude. No doubt, each element matters but without attitude; the success becomes incomplete.

 Time Management and Success:

Time Management for Success

One should target accomplishment of goals, bringing of positivity, encashment of big opportunities, and self-improvements to have success in life. If the vision of a person becomes clear and high, he or she always moves in the right direction to achieve it. Each action leads to contribution in achievement of the overall aim and one should not go beyond the aim; however if required the skills should be sharpened at regular intervals to be more capable of achieving the aim.

Adopt Good Habits and Leave Vices:

There are 6 basic thumb rules to adopt in life:

Work harder

Leave Vices

Courage to outperform

Self Confidence

Capability for patience

Committed to work

Never listen the people with negative attitude.

Negative Attitude makes Lazy:

Be confident, if you have determined to achieve big dreams, definitely you will find the ways and if you have decided to do nothing in life, then also you will find numerous excuses to avoid the work.

Using Double Tenses in Sentences

 Using Double Tenses in Sentences

-Rashmi

English is a very easy language. Like Hindi, the Indians can easily form sentences in English even if the language is not learned by them from childhood. As we form the sentences in Hindi with multiple tenses together, it is possible in English also to form a sentence with double tenses.

Simply Learn English With Rashmi Madam

Past Indefinite and Past Perfect:

When an activity has been completed before the completion of another activity in the past. The formula for forming an accurate sentence in such circumstances is, to use past perfect for the activity which had been completed earlier and past indefinite for the activity which had been completed later on.

Example:

Suppose Mr. A is sleeping and Mr. B comes to his home to meet him. On the next day, how this scene will be covered in a sentence. The activities of sleeping of Mr. A and Coming of Mr. B are separate activities completed in past. How to connect two tenses Past Perfect and Past Indefinite in this sentence?

The sentence will be as under:

Mr. A had slept before Mr. B came.

Examples of such activities with the use of Past Perfect and Past Indefinite Tenses:

The beggar had run away before the dog barked.

I had washed the clothes before you came.

The wall had collapsed before the mason came.

We had gone before the bride came to the marriage function.

Rules and Policies for Management

 Rules and Policies for Management

-Dr. Lalit Kumar Setia

The businesses took place in various forms of business organizations such as sole proprietorship, partnership, cooperative societies, companies, etc. In each form of business organization, there are set objectives determined to be achieved. I have been invited as Guest Speaker in a seminar on “Democratic System, Business Management, and Right to Information Act” organized by HARCOFED, Panchkula. The cooperative societies are promoted by HARCOFED by visiting schools, colleges, and industrial training institutions and organizing various types of events for the students and youth.

During my lecture on “Business and Financial Management for Cooperative Societies”, I explained how rules and policies make an impact and facilitate the management to run multiple branches of an organization.

Rules and Policies for Management

The big corporate players are successful by enabling automation nowadays, earlier they were dependent upon the Chief Executive Officers, entrusted to follow the policies and rules formed to run the business in standard forms as per the desire of the owners, the big corporates.

Need of professionalism in Work:

Cooperative societies have an acute need for professionalism in work and due to lack of professionalism, there are huge losses in managing the affairs of cooperative societies. Instead of democratic control and specified bye-laws; the businesses are facing losses.

There are various mantras of success in modern businesses and I explained with examples and practical question-answers to make the session interactive.

Capacity Building of Officers to comply with Rules:

Each Organization is expected to comply with the financial rules, policies formed by top management, and instructions issued from time to time. In inspecting the financial records, annual accounts, and administrative reports it is generally observed that even the previous year's audit observations are not sorted out.

Group Dynamics and Change in Environment

Since there are a lot of financial irregularities in the accounts of the organizations and the use of technological tools in competitive organizations poses a new challenge to be dynamic and innovative; the decisions are being taken to follow the Standard Operating Procedures (SoPs), adopting software in functions, and use of social media platforms for marketing of goods and services. The political scenario is also changed from time to time and the innovations required to be further updated with the use of IT and new technological tools as per the change in the business environment.

Course with New inputs

It is natural when the business environment is changing and organizations are adopting new software, revising Standard Operating Procedures (SoPs); the course is also revised with new training inputs.

Training of Officers/Officials on ensuring compliance with rules and policies of management is a must for performing well and resolving the audit observations. I am proud of my sincere participants to stay punctual always and take a keen interest in learning new ways to deal the practical problems.

Taxation and Procurement Procedures

For most of the Officers, the taxation procedures are challenging to deal with the amended provisions, rules, sections of acts including income tax and GST. The courses in Taxation and Procurement procedures include e-TDS, e-filing Income Tax Return, e-Procurement, and use of systems including Integrated Financial Management System (IFMS). With an opportunity to learn financial inputs, each course is a boon for a solution-finder to sort out the practical problems with face-to-face interactions.

Assignments and practical orientation in Whatsapp Group:

For each course, a WhatsApp group is created for discussing and interacting with the practical issues and at the end of each day of training, the participants get the opportunity to attempt an assignment for practically revising the key learnings of the course.

Updates to prepare for upcoming challenges

The too much change after every 15 days, in taxation and procurement procedures, is really a challenge for the officers and auditors to re-build the capacities.

How to Complete HRMS Records?

How to Complete HRMS Records?

-Dr. Lalit Kumar Setia

The Government of Haryana, issued instructions from time to time to complete the HRMS records of employees working in each office of Government. The departments are working with Departmental Admin User Account (DAU), Level Admin User (LAU) Account, checker and maker accounts in the head offices and field offices. There are permissions set by the Departmental Admin User to ensure proper discipline in administrative matters of the department.

How to Complete HRMS Records

How to complete records on Human Resource Management System (HRMS)?

Need not to say that the responsibility for completion of records on the HRMS portal lies with the Head of Departments (HoDs) as per the functions set in the module of HRMS. Above HoDs, there are logins of Administrative Secretaries and Chief Secretary to Government of Haryana also. In the second phase, the HRMS had been extended to the Boards and Corporations, Autonomous Bodies, Universities, etc. all are required to complete the HRMS records.

Six Matters to be focused on by each organization:

1. Service Record of each Employee

From the date of joining to the current date, the service record of each employee should be completed on Human Resource Management System (HRMS) portal. What to do? How to check? How to complete it?

The Standard Operating Procedure (SoP) of HRMS states that the DAU will give permission to LAU, LAU will give permission to Checker, Checker will give permission to the Maker for completing the service record of each employee in the head office and field offices of the department. This work is required to be updated every day. Apart from making entries in the service books of the employees (in historical and future transactions), the hard copy of the service book should also be scanned and uploaded on the HRMS portal at regular intervals.

2. Promotion and ACP Cases of Employees

The powers to promote or grant ACP are generally in the hands of appointing authorities of an employee, as per the service rules; however, the administrative powers of Head of Departments or Head of Offices can be altered by the Administrative Secretaries of the Departments. Whatever the status of permissions in the HRMS portal, it is the duty of each Checker in the HRMS portal to check and validate the details of promotion and ACP in the system. What to do? How to do it? How to Check whether it is done or not?

The entries of promotion and grant of ACP can be checked in the service record of each employee. In case, the record is incomplete, it is required to generate the orders and upload the same in the HRMS portal. As per the mandate, it is restricted to draw the salary with ACP until the order of ACP is uploaded. Therefore, it is directed by the Haryana Government from time to time to make the entries of promotion and ACP in HRMS and also check whether the entries are completed or not.

3. Leave Record of each Employee

The entry of leave record is generally done by the Makers, and the responsibility to ensure its correct entries lies with the Checkers and concerned LAU or DAU as the case may be. After completing the leave record, the next superior authority is required to verify the same at his/her level.

4. Transfer of Employees

The transfer without an entry in the HRMS portal creates problems and the tracing of employees at the level of Head of Departments and Administrative Secretaries becomes complicated. Therefore, no transfer should be done without creating transfer orders in the HRMS portal and it is a must to ensure the entry of each transfer in the HRMS system. Once the entry is done and verified, the entry is frozen and can only be amended at the level of NIC with the help of held desk operations.

5. Completion of Annual Confidential Reports (ACRs)

The ACR reports can be uploaded in the Historical and Future Transactions in the HRMS portal. It is the duty of Checkers and Level Admin Users to ensure the completion of uploading ACR and verification of the same.

6. Disciplinary Matters

The matters of absence from duty, suspension, punishment, etc. required to be entered with due care by the checkers of the offices. It is generally found that the persons absent from duty are not treated strictly and after a long run of time, it is detected that entries for absent from duty are not made in the HRMS. The concerned maker and checker are held responsible for such missing entries. Therefore, it is a must to ensure entry of all disciplinary matters in the service book of the concerned employee.

Disclosing Facts behind Biological Evolution

 Disclosing Facts behind Biological Evolution

-Dr. Lalit Kumar Setia*

Disclosing Facts behind Biological Evolution

Theories of Origin of Life

Even in today’s age of science and technology, there is consensus among scientists that how the universe had been created whether there had been a massive explosion that created the majority of matters, or there had been something different that happened around 13.8 billion years ago. The scientists have constructed a timeline of events that began with the Big Bang (a theory which states that the universe is created through a massive explosion) and the same created universe has led to the current state of cosmic evolution. After the creation of the universe, how first stars, galaxies, and planets are formed? Though astronomers have been studying stars for thousands of years, it is only in the past 35 or so years that they have been able to employ instruments that detect light across the entire electromagnetic spectrum–from radio waves to gamma rays–to peer into the dust clouds where stars are born in our own Galaxy[i].

Galaxies in Universe

These galaxies, stars, the solar system, and earth have been changing from the day of their formation and Darwin called this process “descent with modification”, which remains a good definition of biological evolution today[ii]. The evolution states that due to the splitting process, populations split off from one another and gradually become different. The unanswered or doubtful facts are still compelling mankind to have research and find out the reality behind evolution. With the expansion in-universe, the population of living things also increases with the passage of time. Before birth, from where a living thing comes and after death, how the living thing converted into a dead body; where the living thing goes after leaving the body; there are numerous questions demanding answers even today.

Movies disclosing Evolution

There are documentary movies available online showing miraculous developments of the fetus during the time in the womb e.g. Life Before Birth is a documentary movie that shows such development using 4D ultrasound imagery and innovative computerized animations. Such crucial questions may be answered with the study of Indian Scriptures. After a successful performance in and as Jattu Engineer, Saint Dr. Gurmeet Ram Rahim Singh Ji Insan is coming again to entertain but this time, the idea behind the new movie Online Gurukul is quite different. The shooting of ‘Online Gurukul’ has been made in Haryana’s Film City ‘Sirsa’. The movie will disclose the secrets behind the evolution of the universe. There are missing links in Darwin’s Theory of evolution and science is continuously trying to discover the accurate way in which the universe had been developed. The unfolding of mysteries on the evolution of the universe is a great challenge in front of modern science.

Indian Mythology

According to Saint Gurmeet Ram Rahim, Indian Mythology is the mother of modern science and the scriptures contain everything for which modern science is trying to research without going into the depth of scriptures. He will be playing six or seven different roles in the movie for the promotion of India’s heritage and culture through the movie. Recently, Saint Dr. MSG has originated a new game known as Tiranga Rumal Chhu and in ‘Online Gurukul’, he will be playing this game for promoting rural sports of India.
Based on Vedic concepts, the ultra hi-tech movie shall galvanize the children and youth against terrorism. The movie will also depict India’s unique culture and will set a milestone in making the entire world aware of India’s diverse culture.

Approaches to Learn Something New

Approaches to Learn Something New

-Dr. Lalit Kumar

I, Dr. Lalit Kumar Setia sharing my own thoughts in this article. How a person grows, how a person learns, how a person succeeds or fails in life.

Approaches to Learn Something New

From childhood, everyone learns from their surroundings and the learning continues till the end of life. Up to the first 10 to 15 years of learning, the approach of teaching is used by the teachers and the major emphasis is upon What and How. The basic understanding of the concepts and technologies, procedures, and functioning of each living or non-living item makes a person mature enough to understand and live a healthy life.

After the 10 to 15 years of learning, when a mature person starts going to college, the approach is changed and the major emphasis becomes upon Why than the What and How. Whatever is interacted in the colleges, make the person knowledgeable and smart enough and such interactions change the perspectives of the learner. During this tenure of 15 to 20 years of learning, if a person is disciplined and learns with sincerity, he becomes able to either work in a reputed job or set up his own enterprise or shop or firm or company.

After 20 years of learning, at this stage, the real experience starts. The person learns from the actual situations of life by using the trial and error method. Whatever comes in life, makes the person learn by doing experiments, applying his own ideas to get rid of practical problems. The approach of learning changed from ‘getting taught’ to ‘being trained’. The real-life situations, case studies, practical aspects of each function, and field visits such as ‘Visits to Companies’, ‘Visits to Developed Nations’, and even ‘Visits to Rural Areas’ give exposure to new life situations which are being faced by others and how they are tackling their problems to live a successful life.

How Visits to Places enrich Learning?

Classroom teaching and on the work training are the methods that make people grow to perform in an extraordinary way. The Visits to Places is entirely different which exposed the people to the real-life situations and complexities of life. Everyone grows in a different environment, some people come from poor families with living entire life with constraints of money to buy adequate goods and facilities, on the other hand, some people comes from rich families with plenty of resources to choose as per their desire to use in life. Both categories of people can learn from each other. Some people come from families with a background of Doctors / Engineers / Judges, on the other hand, some people come from families with a background of Shopkeepers / Businessmen / Industrialists. Again there are lessons to learn from each other.

Building Perspectives and Success Mind-sets

Irrespective of background, each person plays his own roles in life, deals with dynamics with observing problems and finding solutions; the approaches are different but some elements always let others learn to tackle their practical problems. The rural areas are visited to witness how poverty, income inequalities, regional inequalities affect the lives of people and their perspectives on life. No doubt, all developing and under-developed nations formulate plans to alleviate poverty, minimize income inequalities and also ensure equal development for reducing regional inequalities; but whether the plans and policies work at the ground level or not and if they work, to what extent change comes in the life of rural people, it is always studied in researches of social sciences.

In Haryana Institute of Public Administration (HIPA), I got an opportunity to accompany the trainees of an induction course (Indian Telecom Service Executives) to visit the villages of Nuh which is one of the underdeveloped areas of Haryana. The Officer Trainees gained a first-hand understanding of the life of rural people and we stayed in the villages to have a look at the life of people how opportunities are grabbed whenever comes in result of plans and policies of the Government. In a visit, it is expected from the visitors to build their perspectives to face challenges and form a successful mindset even in the alarming situations of life.

How persons from poor families are becoming IAS in 2021

The aspirants who prepared for the IAS examination, are millions of people from both poor and rich families. In 2021, the newspapers published news on various qualified IAS in which it is explained how people who are doing farming with study, doing small businesses at a young age, whose parents are laborers, etc. are becoming IAS. It does not mean that rich people are not enough intelligent. It may also mean that rich people prefer to do business than become IAS Officer. The interviews of the newly joining IAS Officers clarify that how they made a struggle to be successful in life.
